  • Law and History in Angola

Open Access•M P Candido, Mariana Armond Dias Paes et al.•ARTICLE•History in Africa•2024•References: 31

Court records are rich primary sources to social historians, and much attention has been paid to these types of documents in different African territories. In most cases only summaries have survived, but in Angola complete proceedings have been preserved. Examining the court case collection available at the Benguela District Court, we discuss its strengths and methodological challenges, and present possible themes for future research. The use of …

  • Current Trends in Slavery Studies in Brazil

Open Access•Mariana Armond Dias Paes, Martha Abreu et al.•BOOK•Current Trends in Slavery Studies…•2023•References: 52

African slaves were brought into Brazil as early as 1530, with abolition in 1888. During those three centuries, Brazil received 4,000,000 Africans, over four times as many as any other American destination. Comparatively speaking, Brazil received 40% of the total number of Africans brought to the Americas, while the US received approximately 10%. Due to this huge influx of Africans, today Brazil’s African-descended population is larger than the p…

  • To be dependent in the Brazilian Empire

    Open Access•Mariana Armond Dias Paes•ARTICLE•Población & Sociedad•2020•Cited by: 1•References: 23

This article examines the arguments used in an 1835 court case filed before the Court of Appeals of Rio de Janeiro. This analysis highlights t hat: a) the considerable number of African slaves and the existence of a shared culture in the South Atlantic had a strong impact on freedmen’s and freedwomen’s experiences of freedom; b) masters resisted freedpersons demands for rights and tried to sust ai n dependency relations; and c) in a context of pr…

  • Shared Atlantic legal culture

    Open Access•Mariana Armond Dias Paes•ARTICLE•Atlantic Studies•2020•Cited by: 7•References: 16

Through an examination of arguments used in an 1866 freedom suit initiated in Benguela, this article highlights the existence of a shared legal culture in the Lusophone Atlantic. Through in-depth analysis of this case, I show how common institutions of the ius commune acquired specific meanings in the pro-slavery jurisdictions of Benguela and Brazil. I specifically focus on how legal categories of property law shaped the judicial language of free…

  • Legal Files and Empires

    Open Access•Mariana Armond Dias Paes•ARTICLE•Administory•2019•Cited by: 3•References: 4

Much has been said on the role of judges, legal officials, and courts in the making of colonial regimes. Nevertheless, historiography lacks specific methodological reflections on lawsuits in the Iberian Empires. In order to raise some methodological issues concerning lawsuits as primary sources, I argue that historians could also engage with legal files by looking at instead of just looking through them. In this sense, I seek to establish a dialo…

  • Escravos e terras entre posses e títulos

    Mariana Armond Dias Paes•THESIS•2018•References: 27

This thesis aims to analyze the social construction of relations between people and things in Brazil between 1835 and 1889. For this purpose, I analyzed 74 legal proceedings that were processed before the Court of Appeals of Rio de Janeiro and which discussed dominion and possession over slaves and land. In the first chapter, I analyze the contours that the legal category of possession acquired in nineteenth-century Brazil. Then I analyze the rol…

  • Legal Reasoning in a Slave Society (Brazil, 1860–88)

Open Access•Pedro Jimenez Cantisano, Pedro CANTISANO et al.•ARTICLE•Law and History Review•2018•Cited by: 9•References: 17

This article analyses arguments used in an 1866 Brazilian freedom suit to highlight a substantive legal perspective. Historians of Brazilian slavery law have given attention to the politics of freedom suits, largely disregarding the role of law in their origins, developments, and outcomes. By looking at legal arguments, we show how law and political views mutually framed each other. We focus on the impact of 19th century legal modernizations in t…

  • Sujeitos da história, sujeitos de direitos

    Mariana Armond Dias Paes•THESIS•2017•References: 2

In this research, I argue that Brazilian slaves, at least since the 1860s, had legal personality. This legal personality was limited and precarious. In the first chapter, I analyze the concept of "legal personality" in Brazilian and Portuguese legal doctrine. In the second chapter, our focus is slaves' right action. Through the analysis of the selected documents, I discuss various aspects of this right: a) slaves' standing; b) the requirement of …

  • L'histoire devant les tribunaux

Open Access•Mariana Armond Dias Paes, Marlene Monteiro•ARTICLE•Brésil(s•2017•References: 8

  • O Procedimento De Manutenção De Liberdade No Brasil Oitocentista

    Open Access•Mariana Armond Dias Paes•ARTICLE•Estudos Históricos (Rio de Janeiro•2016•Cited by: 6•References: 6
