Levelling the odds of LGBTIQ+ asylum seekers: The interaction of legal representation and credibility in asylum appeals in Switzerland
This article concerns the interplay of legal representation with credibility and how it affects LGBTIQ+ asylum seekers’ appeal cases in court. We argue that (quality) legal representation increases the likelihood of a positive decision and that these effects are even more pronounced for sexual orientation and gender identity (SOGI)-related claims. Using a data set of 44,406 Swiss appeal case files from 2007 to 2023, we run regressions and confirm…
The Global Challenge of Mass Migration and Asylum: Comparative Analysis of Street-Level Organizations at the Front Lines
As millions of individuals flee conflict, persecution, and hardship in search of safety and better lives, destination states in Europe and North American have struggled to respond. Street-level theory provides an analytic lens for investigating these struggles and how they evolve on the ground through the informal practices of street-level organizations (SLOs), where the law and individuals meet. This introduction presents an overview of our spec…
Asylum Adjudication and Street-Level Discretion: Negotiating Practice Rules
Studying asylum adjudication in Switzerland, this article investigates how frontline practitioners in street-level organizations (SLOs) effectively exercise collective rulemaking power when they engage in construction of procedural rules, known as "asylum practice" rules.Asylum practice rules aim at standardizing decision-making by defining which profiles can be protected or not, according to each country of origin. These rules potentially influen…
From international law to subnational practices: How intermediaries translate the Istanbul Convention
The implementation of international human right treaties is particularly challenging, especially when they entail obligations that apply at the subnational level. In this article, we examine how international law intermediaries translate and use international treaties in subnational policymaking processes. We develop a dedicated analytical framework, and we derive a typology, characterizing different types of intermediaries and systematizing the …
Detention Decisions: Implementation Rationales of the Bureaucratic Use of Immigration Detention in Swiss Cantons
This article analyzes the coexisting meanings, interpretations and functions underlying the varying uses of immigration detention in Swiss cantons. The authors argue that cantonal immigration bureaucracies decide on administrative detention according to different and intertwined implementation rationales, revealing varying functions and reasonings which shape its uses in practice. This highlights the significant variation in subnational policies …
Bureaucracies Under Judicial Control? Relational Discretion in the Implementation of Immigration Detention in Swiss Cantons
Based on interviews with bureaucrats and judges in several Swiss cantons, this article analyzes how bureaucrats decide to order immigration detention and how the judicial review shapes their decisions. The authors argue that discretionary decision-making regarding immigration detention is structured by the web of relationships in which decision-makers are embedded and affected by the practices of other street-level actors. The varying cantonal co…
Asylum decision-making and discretion: Types of room for maneuver in refugee status determination
By mobilizing ethnographic methods to study the Swiss asylum administration, this article analyzes the discretionary powers of Swiss asylum caseworkers in a context characterized by an important sophistication of law. Starting from the observation that the daily work of asylum caseworkers is strongly oriented and controlled by their superiors and colleagues, by institu-tional rules and guidelines, as well as by their socialization, the author ide…

Taking the ‘Just’ Decision: Caseworkers and Their Communities of Interpretation in the Swiss Asylum Office
Decision-making in street-level bureaucracies has often been portrayed as being riddled with a practical dilemma: that of having to juggle between compassion and rigid rule-following. However, drawing on three ethnographic studies of Swiss asylum administration, we argue that often what are from the ‘outside’ perceived as conflicting rationales of decision-making, are not experienced as such by the caseworkers themselves. Rather these different r…

From the Law to the Decision: The Social and Legal Conditions of Asylum Adjudication in Switzerland
Starting from an ethnography within the State Secretariat for Migrations in Switzerland, this article addresses the issue of discretion in law enforcement by analyzing the conditions in which Swiss asylum caseworkers make their decision. This article argues that social and legal constraints frame caseworkers' practices and favor a strict interpretation of the law when implementing it. If evolutions of legislation have indeed strengthened the law,…
