Legal fictions and settler colonialism: The case of the Defence (Emergency) Regulations, 1945 in Israel and the Occupied Palestinian Territories
The Israel‐Hamas War One Year Later: Mass Violence and Palestinian Dispossession
This essay analyzes the Israeli offensive in the Gaza Strip as it has unfolded in the year since Hamas's October 7, 2023, attacks. It first details the death and destruction Tel Aviv has wrought over that period, the predictions for mass casualties to come, and the state‐sanctioned violence and theft faced by Palestinians not just in Gaza but across the occupied territories and Israel. It then examines why Washington's support of Tel Aviv has rem…
Israel, Annexation, and Sovereignty: Within the Green Line and Across It
From the early years of Israel’s occupation of the West Bank and Gaza Strip, observers predicted that their de facto annexation might occur. Fifty-seven years later, it has happened. Although governed differently than other zones within the Israeli state, neither territory can be separated from Israel. Yet, the territories’ official status is that they are not part of the state. We offer four reinforcing analyses—legal, historical, discursive, an…
The Israel‐Hamas War: Historical Context and International Law
This essay contextualizes the 2023 Israel‐Hamas war within a century‐old legal history of Palestinian dispossession that has been facilitated through the violation and misuse of international law. It argues that Hamas's attacks of October 7 were not simply driven by sanguinary hatred of Jews, as some commentators have suggested. Instead, the war crimes were motivated by the Palestinians’ disillusionment with an international system that has consi…
The Palestinian human right to full Israeli citizenship: Between settler colonialism and a hard place
This article examines the significance of a legal analysis supporting the recognition of a Palestinian human right to Israeli citizenship for the advancement of equality in Israel-Palestine. It does so by assessing the workings of Israeli citizenship in accordance with the theoretical frameworks of the nation-state and settler colonialism and in light of the one-state reality. The article demonstrates the importance of treating the two frameworks…
The jurisprudence of elimination: Starvation and force-feeding of Palestinians in Israel's highest court
This paper assesses the functioning of law and legal institutions in Palestine/Israel through the lens of settler colonialism by analysing two thematically interconnected decisions issued by the Supreme Court of Israel, the first involving the starvation of besieged Palestinian civilians and the second involving the force-feeding of Palestinian prisoners. Following a discussion regarding the role of law in settler colonialism, it proceeds to argu…
