  • When might claims of “too much litigation” be other than political sloganeering?

    Open Access•William Haltom, William T Haltom et al.•ARTICLE•Oñati Socio-legal Series•2021

This paper answers “Too Much Litigation?” in three ways. First, when politicos presume or assert that the culture of the United States suffers too much litigation, they often trade in political talking points, expedient distortions, disingenuous enumeration, and opportunistic anecdotalism that tend to preserve or increase the advantages of those who have more over those who have less. Second, when analysts inquire what kinds of litigation serve w…

  • Criminalizing Big Tobacco

    Open Access•Michael Mccann, William Haltom et al.•ARTICLE•Law & Social Inquiry•2011•Cited by: 6•References: 8

This article reinterprets the discursive terms and cultural meanings that redefined the legal campaign against Big Tobacco during recent decades. We underline the palpable shift from a conventional tort-based logic of products liability claims, which most analysts emphasize, to a logic incorporating key features identified with criminal law or “crimtorts.” The study builds on legal mobilization theory and combines narrative history of events with…

  • Ordinary Heroes vs. Failed Lawyers—Public Interest Litigation in Erin Brockovich and Other Contemporary Films

    Open Access•Michael Mccann, William Haltom•ARTICLE•Law & Social Inquiry•2008•Cited by: 3•References: 3

Although feature films may overpraise lawyers and civil courts as means of securing justice, they caricature lawyers and litigation. Analysis of Erin Brockovich (directed by Steven Soderbergh and produced by Danny DeVito, et al., 2000) reveals four motifs—two favorable and two unfavorable to public‐interest litigants and litigation—that characterize similar films in the last decades: Class Action (1991) , The Rainmaker (1997) , The Sweet Hereafte…

Q uality survey data require surveyors to ask the right questions of the right respondents. This requirement is particularly acute for preeminent data sets and templates for other research. The 1984 Ameri_ can National Election Study (ANES) supplemented an item used since 1972 with a new measure of ideological self-location. This paper compares responses to old and new questions and assesses the relative reliability and validity of variables deri…

  • Issues, Voter Choice, and Critical Elections

    Open Access•W L Bennett, William Haltom•ARTICLE•Social Science History•1980•References: 26

The study of critical elections in American politics has been marked by a steady growth of knowledge and a remarkable consensus among practitioners in the field. Although minor quibbles have appeared from time to time, the work within each generation has set the agenda for the work of the next. The pioneering efforts of Key (1955, 1959), Schattschneider (1960), and MacRae and Meldrum (1960) produced clear descriptions of the phenomenon of critica…
