No obstante, tales discursos tienen raíces …
Legal empowerment of the poor: With a Little Help From Their Friends
In 2005 the initiative to create a High Level Commission on the Legal Empowerment of the Poor, to be co-chaired by Peruvian economist Hernando de Soto and former US Foreign Affairs Secretary Madeleine Albright, was launched with strong support from the Norwegian government. This article first reviews some of the debate surrounding the initiative, giving special attention to the role of Norwegian civil society organisations that questioned central…
Land tenure, land law and development: Some Thoughts on Recent Debates
This paper offers a discussion of some of the features of recent land tenure debates and policies. It argues that two different orientations can be discerned: one that tends to regard land primarily as an economic asset and another that rather takes a (human) rights orientation and emphasises food and shelter security.
Land Tenure and Tenure Regimes in Mexico: An Overview
This article provides an overview of the evolution of land tenure and tenure regimes in rural Mexico from colonial times to the present. It shows how, by the late nineteenth century, the dual system of indigenous communal tenure and Spanish and criollo landholdings was undermined by liberal legislation that sought to privatize community lands. This resulted in a process of disappropriation and concentration of land in a few hands, which created t…
Autonomy Rights and the Politics of Constitutional Reform in Mexico
Like other Latin American states Mexico has modified its constitution to recognize the multiethnic and pluricultural make-up of its population. The federal charter was reformed in 1992 and again in 2001. Legislation has also been reformed or is in the process of being renewed at the level of the states. This article seeks to assess the scope and depth of these changes on the basis of the work of a research team that followed the process of consti…
Land tenure legislation in a pluri-cultural and multi-ethnic Society: The case of Bolivia
After considering notions of social justice as they are related to concepts of 'development', this article seeks to provide a regionally differentiated overview of the evolution of land tenure in Bolivia and the way arrangements for land tenure legalization have been contested and negotiated over time. It will show how the colonial 'reciprocity pact', which entailed recognition of indigenous tenure systems came under attack from liberalizing poli…
Ethnicity and politics in Bolivia
In recent years polarization along ethnic lines has become an important feature of Bolivian politics. In this article we examine the emergence of new indigenous movements in Bolivia and how this was eventually reflected in the adoption of multiculturalist policies by the Bolivian state. However, in an overall context of neoliberal economic policy and a party system that suffered a ‘representation deficit’, such policies may celebrate cultural plu…
The Challenge of Diversity in Rural Latin America: A Rejoinder to Jean-Pierre Reed (and Others)
A review in the Journal of Peasant Studies by Reed [2003] of our book on indigenous movements and the state in Latin America provides a suitable opportunity to discuss several comments on questions raised in that text. In this rejoinder I argue that we do not judge neoliberalism a positive factor that provides indigenous peoples with a democratic space to press their demands. I show that our discussion of the neoliberal 'cultural project' provide…
Bolivia: A Gasified Democracy
In October 2003 a wave of popular protest brought down the Sánchez de Lozada government in Bolivia. The intention to export natural gas to the United States and Mexico triggered the protests, but actually stood for widespread discontent with the Sánchez de Lozada government, the preceding governments and the economic policies pursued since 1985. The events belie the opinion of various students of the Latin American democratic transitions who held…

David versus Goliath in Cochabamba: Water Rights, Neoliberalism, and the Revival of Social Protest in Bolivia
Ours is a small country and it hardly owns anything any more. Our mines were privatized, the electrification company was privatized, and the airlines, the telecommunications, the railways, our oil and gas. The things we still own are the water and the air, and we have struggled to make sure that the water continues to be ours, said Oscar Olivera, a trade-union leader from Cochabamba, Bolivia, addressing one of the assemblies protesting the annual…

Multi-Ethnicity, The State and The Law in Latin America
Indigenous peoples in Latin America have developed new forms of activism against state projects aimed at their social integration and entailing the expropriation of their lands. Their expressed claims to self-determination or autonomy have influenced the reforms of state constitutions and other laws, and have stimulated a wide interest in issues of ethnicity, as evidenced by the six volumes discussed in this article.Constitutional frameworks in a…
Theory, Practice and'External Actors'in the Making of New Urban Social Movements in Brazil
Spontaneity and authenticity have often been key words in the analysis of the'new urban social movements'that emerged in Brazil in the course of the 1970s. The movement discourse was often taken at face value and the involvement of other than'popular'institutional and social actors tended to be concealed. Though in some analyses attention has been directed to the role of the Catholic Church and other institutional actors, very little has been sai…

Urban Social Movements in Brazil: A Debate and Its Dynamics
An intriguing feature of the Brazilian debate on urban social movements as it has developed over the past 15 years or so is the shifts in theoretical approach. The vicissitudes of the debate derive from the particular relation of the social sciences to their object or what we might call the recursive character of the social sciences (Giddens, 1984: 348). Social theorizing reflects upon and contributes to the transformation of its own object (Tayl…

The agrarian question in Peru: Some observations on the roads of capital
Under the military governments of Velasco (1968-75) and Morales Bermùdez (1975-80) one of the most important agrarian reforms of South American history took place in Peru. According to Alain de Janvry [1981] this reform involved a shift from a junker-road to a farmer-road toward the development of capitalism in Peruvian agriculture. In the first part of this study de Janvry's approach to the 'agrarian question' and his evaluation of the Peruvian …
