Disinheritance and Will Contests as Reciprocity and Deviance
Traditional content analysis of the 319 last wills probated in Providence, RI, 1985, was used to test eight of Rosenfeld's empirical generalizations about the social characteristics of disinheritances and will contests and his explanation of them in terms of Gouldner's concept of the norm of reciprocity. Many of Rosenfeld's generalizations are applicable to the Providence data, although disinheritance might be “drifting down” into the middle and …
Durkheim's Prediction About the Declining Importance of the Family and Inheritance
In 1912 Emile Durkheim predicted that testators would shift their beneficiaries in their last wills from their families to organizations as societies industrialized, primarily because the family would decline as an economic institution. This article analyzes and expands Durkheim's prediction into a “Durkheimian” theory of organizational inheritance. Content analysis and qualitative analysis of all 319 last wills that were filed in Providence Probate Court, 1985, revealed that about ten percent of the testators used testamentary material, disinheritance or altruism to express their individuality. About 42 percent of the wills were personalized directly in other ways. Forty-eight percent displayed indirect influences of family, friends and community.
