  • American-Chinese Controversies in the Field of Marine (Scientific and Military) Research of the World Ocean

Moscow Russia IMEMO RAS, Pavel A GUDEV•ARTICLE•Southeast Asia Actual Problems of…•2023

The 1982 UN Convention on the Law of the Sea introduced a regime for conducting marine scientific research. However, a significant flaw in this regime was that the text of the Convention does not specify anywhere what "marine scientific research" is. This has led to the fact that in the maritime zones of sovereignty of coastal States there are no disputes regarding the permissive procedure for their conduct. In the zones of sovereign rights and j…

  • American-Chinese Controversies Around the Taiwan Strait (Part 2. Legal Interpretations and Controversies)

Pavel A GUDEV, Igor O Mishin•ARTICLE•Southeast Asia Actual Problems of…•2022

China, while insisting that the definition of "international waters" does not apply to the entire Taiwan Strait, especially emphasizes which maritime zones of sovereignty and jurisdiction predominantly comprise its water area - the territorial sea and the exclusive economic zone. The article examines in detail the restrictions that exist both at the level of national legislation of the PRC and on the part of other states concerning the exercise o…

  • American-Chinese Controversies Around the Taiwan Strait (Part I. Essence of the Terminological Dispute)

Pavel A GUDEV, Igor O Mishin•ARTICLE•Southeast Asia Actual Problems of…•2022

For decades, the Taiwan Strait has been one of the main "hot spots" in the Asia-Pacific region. As an object of confrontation between China and Taiwan, the U.S. and China, the area is strategically important to the entire global economy and international shipping. The strait connects the South China Sea with the East China Sea, through which up to 80% of world trade passes, and it is also a crucial link in the global supply chain. Even a short-te…

  • Foundations of Turkish Claims in the Eastern Mediterranean

    Open Access•Pavel A GUDEV•ARTICLE•Vestnik RUDN International…•2021

The Eastern Mediterranean is becoming a new region of interstate confrontation and clash of national interests. This is largely due to the discovery of oil and gas reserves, the development of which is becoming possible with the existing technology. The Republic of Turkey has a special position regarding this maritime region. The paper analyzes those bases - historical, political and legal - that determine Turkeys current policy with regard to ma…

  • Political and Legal Aspects of the U.S.–Iranian Confrontation in the Strait of Hormuz and Adjacent Waters

    Pavel Gudev, Pavel A GUDEV•ARTICLE•Vostok Afro-Aziatskie obshchestva…•2020

An analysis of the decisions of the UN International Court of Justice regarding the laying of sea mines found that in each case such actions were considered illegal because they interfered with commercial/military navigation and violated the rights of coastal and other states. Importantly, it was also found to be illegitimate to respond, including by using force and arms, for the mining without tangible evidence of a state's guilt

  • Political and Legal Aspects of the U.S.–Iranian Confrontation in the Strait of Hormuz and Adjacent Waters According to Different Versions of Events

    Pavel Gudev, Pavel A GUDEV•ARTICLE•Vostok Afro-Aziatskie obshchestva…•2020

A series of incidents involving ships and aircraft in and around the Strait of Hormuz almost brought U.S.-Iranian relations to the brink of armed conflict. Mutual accusations were coming from both sides, and it was extremely difficult to find out which side was the truth and who was abusing the so-called "Fake News" generations. The first part of the paper explores the main possible versions of what happened, with a focus on their political and l…
