Lower federal courts are crucial to the interpretation and implementation of Supreme Court decisions. Research demonstrates considerable variation in their responses to these decisions. Explanations of these responses are not well developed, and few efforts test competing hypotheses. My research tests the hypotheses derived from two models of lower court behavior-a legal model and a political model. The analysis demonstrates that the legal model …

This paper takes advantage of the change from the Warren Supreme Court to the Burger Supreme Court to investigate a phenomenon not usually examined in judicial impact research—anticipatory reactions. Coercive and Noncoercive Abortion Deterrence Policies
The Supreme Court's decision in Roe v. Wade (1973) limited the authority of states to prohibit abortions during the first two trimesters of pregnancy. Although they can no longer prohibit abortions, state legislatures have adopted a variety of coercive and noncoercive policies that might operate to alter the utilities associated with having or providing abortions. This theoretical note presents a theory explaining the reactions of organizations to court orders that require the organizations to change some policy, program, or pro cedure. The theory is based on theories of "rational choice" and conceives of the change process in terms of four stages: (1) interpretation of the court decision, (2) evaluation of the decision, (3) searches for information and alternatives to the court decision, and (4) selection…

This article tests the widely assumed proposition that the greater the original support for a decision at the Supreme Court level, the greater the subsequent compliance with that decision by the lower courts.
