Intercameral Relations in a Bicameral Elected and Sortition Legislature
The idea of a hybrid bicameral system combining election and sortition is investigated. In 2010, at the tenth Conference of the Parties to the Convention on Biological Diversity (CBD), Parties adopted the Nagoya Protocol on Access and Benefit-sharing (ABS). Ce texte analyse les dispositifs qui permettent de lier, au sein des nouvelles techniques de régulation, la formation d'une norme effective aux sentiments de légitimité et de motivation que cette norme parvient à susciter auprès des acteurs. Notre hypothèse est que toute communauté politique développe un récit pour fonder la légitimité de ses règles collectives. This article analyses the parliamentary debate that recently took place in Belgium and led to the passing of a proposed law enabling homosexual couples to adopt children. It shows that the richness and diversity of the arguments put forward both by the partisans and the opponents of the proposed law exceed the framework of a liberal conception of law and bring into play axiological convictions.
