Covid-19 and Healthcare as a Human Right in Bangladesh
Ethical obligation and legal requirements
Informed consent to medical intervention is fundamental in both ethics and law. But in practice it is often not taken seriously in developing countries. This paper provides an appraisal of informed consent practices in Bangladesh. Following a review of the ethical and legal principles of informed consent, it assesses the degree to which doctors adhere to it in Bangladesh. Based on findings of non‐compliance, it then investigates the reasons for s…

Human rights dimensions of Covid-19 responses in Bangladesh
Purpose The purpose of this paper is to scrutinize the human rights dimensions of COVID-19 responses in Bangladesh through a viewpoint methodology in four critical areas: freedom of opinion and expression; access to information; protection of health-care workers; and marginalized populations’ access to health care. However, these responses remain non-aligned with the international human rights law obligations of Bangladesh, which undermines the h…
The Status and Rights of the Rohingya as Refugees under International Refugee Law
This paper examines the status of the Rohingya in Bangladesh as refugees, the rights and protections they could be entitled to under international refugee law, and the extent of responsibility and burden sharing between the host country, refugee-producing country, and the international community to ensure their rights and durable solutions. However, these rights remain unfulfilled, which hampers the ability of Bangladesh to garner international s…
The Current Rohingya Crisis in Myanmar in Historical Perspective
This paper critically examines the longstanding Rohingya crisis in Myanmar. It argues that the crisis is rooted in the British colonial era that subsequently gained momentum through their (i) gradual marginalization as an ethnic minority, (ii) exclusion from the governmental institutions, and (iii) deprivation of citizenship, effectively rendering them stateless. Starting with a demographic profile of the Rohingya it explores the major elements o…
The National Laws of Myanmar
This article examines the legal status of the Rohingya in Myanmar by analysing relevant constitutional provisions (of 1947, 1974 and 2008) and other major citizenship legislations including the Citizenship Law, 1982. A doctrinal analysis demonstrates that: (i) the earlier Constitutions and laws provided citizenship for the Rohingya (where they were identified as an ethnic minority); and (ii) their status has been changed gradually under the later…
The Rohingya of Myanmar
The Rohingya of Myanmar have been experiencing a range of human rights violations including state-sponsored genocide and ethnic cleansing. Many argue that the genesis of the crisis lies in the denial of their legal status and granting citizenship would offer a solution. This article argues that apart from such legal dynamics, significant theoretical aspects of this crisis require analysis. From a theoretical perspective, the Rohingya’s identity a…
