Law's drawing line
This article examines Japan's age of consent law by delving into court judgements, focusing on unravelling the nuances of how the sexual autonomy of children is interpreted. The study reveals a contradictory stance of the court towards child victim's maturity and capacity, indicating that the legal discourse around a child's autonomy is easily manipulated and framed. It further exposes the susceptibility of children's sexual autonomy to the struc…
Debate on Conflict, identity, and state formation in East Timor, 2000–2017, by Gerry van Klinken, Hoko Horii, Antero Benedito da Silva, Sara Niner, and Gordon Peake
The Bijdragen occasionally organizes a book debate in which we invite three scholars to review a recently published book, followed by a response from its author. In this issue of the Bijdragen, that convention has, by necessity, been thwarted. Not long after the 2019 publication of his important work, Conflict, identity and state formation in East Timor, 2000-2017, James Scambary passed away suddenly. He was just 59.That it occurred at the height of…
Living in a Legal Limbo
This paper examines the reasons and consequences of a lacking birth-registration in Indonesia, as well as the mechanisms to ‘fix’ it. In order to avoid the legal and social consequences of the lack of registration, creative and ad-hoc solutions are crafted – not only by the individual families who face the problem, but also by their community, including local and state actors who are involved in the mechanisms and paperwork. These mechanisms exis…
Child Marriage as a ‘Solution’ to Modern Youth in Bali
The current international approach to child marriage is the complete prohibition of marriage under the age of 18. Child marriage is considered a problem internationally, and those who practice it tend to be viewed as ‘traditional’, that is, insufficiently modern. This article aims to challenge this viewpoint, by discussing data that show that these young people use under-age marriage as a solution to navigate the modern world in which they live. …
Walking a thin line
This article provides empirical evidence on children's agency and capacity in making the decision to marry. Case studies from my fieldwork in Bali contrast the commonly represented image of child marriage as a forced marriage, by demonstrating that in many cases children themselves make the decision to marry. However, considering social power dynamics, is such a decision really the child's? The analysis shows that the current international child …
Pluralistic legal system, pluralistic human rights
This article examines how the existence of multiple legal orders can impact the defense of human rights, by discussing how state legal agents in Bali navigate state law through local concerns and adat (customary) law in cases dealing with teenage pregnancy outside of marriage. In such “emergencies” where the morality of the community is at stake, families, adat authorities and state agents collaborate to find a way to fit these emergency situatio…
A blind spot in international human rights framework
By studying child marriage as a discursive practice, this article argues that the current international legal framework of child marriage is problematic. Transnational organisations dismiss what they consider to be the ‘tradition’ of ‘the South’, while their linear conceptualisation of development fails to recognise the possibility of adolescent agency existing within ‘traditional’ social networks. This overlooked blind spot is a problem we encou…
