  • Punishing the Non-convicted Through Disclosure of Police Records

    Open Access•Paula Maurutto, Kelly Hannah‐moffat et al.•ARTICLE•The British Journal of Criminology•2023•Referências: 39

As police records expand with big data analytics, so too has the range of non-conviction information seeping into the public domain through criminal background checks. Numerous studies have documented the negative effects of background checks for those with criminal convictions, but less understood are the effects of non-conviction records. We draw on 8 focus groups and 52 interviews to understand how the release of non-conviction records are: (1…

  • Algorithmic risk governance

    Open Access•Kelly Hannah‐moffat, Kelly Hannah-Moffat•ARTICLE•Theoretical Criminology•2018•Citada por: 29•Referências: 9

Meanings of risk in criminal justice assessment continue to evolve, making it critical to understand how particular compositions of risk are mediated, resisted and re-configured by experts and practitioners. Criminal justice organizations are working with computer scientists, software engineers and private companies that are skilled in big data analytics to produce new ways of thinking about and managing risk. Little is known, however, about how …

    Open Access•Paula Maurutto, Kelly Hannah‐moffat et al.•ARTICLE•Canadian Journal of Law and…•2016•Citada por: 4•Referências: 4

Reforms to Canadian sentencing law in 1996 and the Supreme Court of Canada decision R. v. Gladue [1999] opened the door to a new normative set of legal practices that endeavour to integrate racial knowledge about offenders’ collective and individual experiences of race relations and oppression into traditional legal criminal practices. One outcome of the reforms and court cases was the formation of dedicated Gladue courts for Aboriginal peoples. …

Specialized courts rely on partnerships with community agencies to address multiple issues related to offending. Despite their popularity, little is known about the implications of such partnerships or about how stakeholders negotiate client support, therapeutic interventions and correctional practices. We analysed six Canadian sites (four drug treatment courts and two community/wellness courts), specifically focusing on how they conceptualize an…

  • Strategic masculinities

    Open Access•Rosemary Ricciardelli, Katharina Maier et al.•ARTICLE•Theoretical Criminology•2015•Citada por: 31•Referências: 8

Expressions of masculinity in prison are most often characterized as being structured in response to an environment that encourages displays of stoicism, bravery, physical prowess and violence/aggression. However, we found that the antagonistic, precarious and risk-prone environment of the prison shapes prisoners’ behaviours and the constitution of ‘normative’ and hegemonic masculinities in more nuanced ways than prior research suggests. Drawing …

  • The mutual constitution of risk and inequalities

Anna Olofsson, Jens Oliver Zinn et al.•ARTICLE•Health Risk & Society•2014

In this article, we examine the conceptual importance of integrating risk and intersectionality theory for the study of how risk and various forms of inequality intersect and are mutually constitutive. We argue that an intersectional perspective can advance risk research by incorporating more effectively the role of such social categories as gender and race into the analysis of ‘risk’ as an empirical phenomenon. In doing so, the intersectional pe…

    Open Access•Kelly Hannah‐moffat, Kelly Hannah-Moffat et al.•ARTICLE•Theoretical Criminology•2012•Citada por: 36•Referências: 6

Studies of punishment have focused predominantly on emerging forms of penal governance, and the revival of punitive forms of punishment. Although this research helps to raise concerns about forms of penal excess and neoliberal penal patterns, it does not clarify how these strategies co-exist with, modify and are re-assembled with older and sometimes seemingly contradictory penal strategies. Our article examines how practices used by Canadian spec…

The discretion that is inherent in legal decision making creates ambiguity about the reasons for parole boards’ decisions. Although research has documented some of the factors shaping parole decisions for male prisoners, the release process for female prisoners remains largely unexplored. This study asks: What characteristics of violent female offenders and their offences do parole boards emphasize in their decision to release? We employ a multi-…

  • Sacrosanct or Flawed

Kelly Hannah‐moffat, Kelly Hannah-Moffat•ARTICLE•Current Issues in Criminal Justice•2010

This article argues that Canadian and many international discussions of gender responsive (GR) penality have substituted male normative criteria with a ‘female norm’ without much critical reflection on the implications of this development and its impact on women prisoners. GR penality is situated within a narrow politics of difference that posits an essentialist characterisation of women as relational, thereby resurrecting past debates about the …

  • Re-contextualizing pre-sentence reports

    Open Access•Kelly Hannah‐moffat, Kelly Hannah-Moffat et al.•ARTICLE•Punishment & Society•2010•Citada por: 13•Referências: 4

In the past two decades, Canadian policies governing the structure and content of presentence reports (PSRs) have shifted to focus more directly on the systematic identification of offender’s criminogenic risk and needs. In this article, we (1) examine how risk-based approaches to offender management have altered the structure and format of the PSR in Canada, and (2) contrast the structure of risk-based PSRs to Gladue reports for Aboriginal offen…

In this paper, we draw attention to new assemblages with risk in order to highlight the multiple forms of knowledge and logics at work in new risk assessment practices. We seek to complicate the theoretical explanations of risk by highlighting how risk logics merge and shift in tandem with various rationalities. For example, when risk is merged with need, needs are reconfigured as criminogenic needs but, in this process, risk becomes a fluid conc…

This article examines the discrepancies between theories of risk and penality and emergent strategies of risk/need identification and management. Working back from the strategies themselves, I argue that the current generations of risk/need technologies are a significant departure from the pessimistic theoretical accounts of risk in criminal justice associated with the ‘new penology’ and ‘actuarial justice’. A major turning point in Canadian federal1 women’s corrections occurred nearly 14 years ago when the federal government accepted the report of The Taskforce on Federally Sentenced Women (TTFSW, 1990). This report mandated a new women-centered and culturally sensitive approach to the management and organization of federal women’s prisons.
