  • Legislating for Brexit

    Open Access•Adam Cygan•ARTICLE•Global Policy•2022

This article analyses the constitutional issues surrounding Parliament's implementation of the 2016 EU referendum result, in particular, the political and legal obligation of Parliament to give effect to the ‘will of the people’. Respecting the ‘will of the people’ lies at the core of any democratic process of government. But the predicament that faced MPs, who overwhelmingly voted ‘remain’ in the referendum, was to choose between their responsib…

  • Participation by national parliaments in the EU legislative process

    Open Access•Adam Cygan•ARTICLE•ERA•2021

Europeanisation has marginalised national parliaments and their democratic practices leading to a ‘de-parliamentarisation’ within the EU. The Treaty of Lisbon included substantive provisions designed to improve participation by national parliaments in EU decision-making, the most significant of which is the allocation of subsidiarity monitoring. This was intended to address concerns that national parliaments are peripheral within the EU Polity, a…

  • De-Europeanisation of UK regulatory governance and the future UK–EU trade relationship

    Open Access•Adam Cygan•ARTICLE•ERA•2020

With the exception of obligations during the transition period until the 31 December 2020, the UK will leave the EU Single Market and will need to negotiate a new regulatory framework for its future trade relationship with EU. The primary issue for the UK will be how much market access it will want to secure and what regulatory obligations will it be required to comply with in return for this. During EU membership, integration led to the UK’s reg…

  • UK Parliamentary Scrutiny of the EU Political and Legal Space after Brexit

Open Access•Adam Cygan, Philip Lynch et al.•ARTICLE•JCMS Journal of Common Market…•2020•Citada por: 5•Referências: 13

This article considers the effect of Brexit upon the UK Parliament and whether Brexit will reverse the ‘de‐parliamentarisation’ that has been identified through EU membership. Supporters of Brexit identified an end to ever closer integration, or Europeanisation, and restoration of parliamentary control over repatriated competences as a key benefit of Brexit. Firstly, this article explores how Parliament may adapt to leaving the institutional stru…

  • Legal Implications of Economic Governance for National Parliaments

    Adam Cygan•ARTICLE•Parliamentary Affairs•2017•Citada por: 2•Referências: 12

This article explores how the post-crisis EU economic and fiscal governance framework has marginalised national parliaments and compromised legislative autonomy, especially in the delivery of social welfare policy. This article argues that one potential consequence of this new regulatory and political landscape is that it creates scope for new form of democratic deficit to arise from the absence of effective accountability of EU economic and fisc…

  • Citizenship of the European Union

    Open Access•Adam Cygan•ARTICLE•International and Comparative Law…•2013•Citada por: 1

The relationship between EU law and international law has, again, recently occupied the European Court of Justice with respect to the compatibility of the EU Treaty with international obligations. It will be recalled that in the Kadi judgment 1 the Court examined whether adoption of a UN Resolution in the form of a Council Regulation 2 which, prima facie, restricted the fundamental rights of Kadi was congruent with principles of EU law. In Kadi ,…

  • Public Healthcare in the European Union

    Open Access•Adam Cygan•ARTICLE•International and Comparative Law…•2008•Citada por: 1

This article examines how recent judgments of the European Court of Justice have interpreted the concept of a service of general interest in Article 86(2) EC in the delivery of healthcare services. The article explores how and why the Court has afforded greater latitude to Member States in organizational matters by not applying competition rules. By contrast, the Court has actively promoted patient mobility and has not applied the derogation in A…

  • II. Eu Citizenship

    Open Access•Joseph A McMahon, Joe McMahon et al.•ARTICLE•International and Comparative Law…•2006•Citada por: 1•Referências: 1

The Court has continued with its expansive interpretation of the Citizenship provisions in Article 18 EC which it had previously acknowledged as being a fundamental right granted to all EU citizens by the Treaty. 1 The case-law of the Court has, in particular, stressed the relationship between the free movement rights under Article 18 EC and preventing discrimination against EU nationals on grounds of nationality and without which the Citizenship…

  • Protecting the Interests of Civil Society in Community Decision—Making—the Limits of Article 230 EC

    Open Access•Adam Cygan•ARTICLE•International and Comparative Law…•2003•Citada por: 2•Referências: 8

In the Commission's White Paper on European Governance 1 and the subsequent Laeken 2 Declaration, the participation of civil society in the Community method of decision-making was viewed as the primary way of engaging directly with EU citizens. The White Paper accepts that participatory democracy is created from the bottom up by ‘groups of people dedicated to the disinterested search for the public interest in society’. 3 This statement recognise…

  • The White Paper on European Governance – Have Glasnost and Perestroika Finally Arrived to the European Union

    Open Access•Adam Cygan•ARTICLE•Modern Law Review•2002

The Commission’s White Paper examining options for reforming European governance was published on 25 July 2001.1 It is coincidental that the document emerged within a month of the Irish ‘no’ vote in their referendum on the Nice Treaty.2 This makes the document all the more pertinent. The Commission seizes upon the Irish decision as evidence that the White Paper raises issues that must be addressed to counteract the apathy and resistance of Europe…
