  • Michael Perry

Open Access•M Cathleen Kaveny•ARTICLE•Journal of Law and Religion•2022

First impressions are mistaken impressions-or so says common wisdom. Most of the time, of course, common wisdom is correct. But every once in a while, a first impression conveysin a flash, in a single instant-a truth about a person that is only burnished and deepened by time and experience. That is the case with respect to my first impression of Michael Perry

  • Covid‐19 and Religious Ethics

Open Access•Toni Alimi, Elizabeth L Antus et al.•ARTICLE•Journal of Religious Ethics•2020

The editors of the JRE solicited short essays on the COVID‐19 pandemic from a group of scholars of religious ethics that reflected on how the field might help them make sense of the complex religious, cultural, ethical, and political implications of the pandemic, and on how the pandemic might shape the future of religious ethics

  • The Remnants of Theocracy

Open Access•M Cathleen Kaveny•ARTICLE•Law Culture and the Humanities•2013

In this commentary I investigate the roots of American exceptionalism in the Puritan conception of the special covenantal relationship of New England (and later, America) with God. I argue that the contemporary culture has maintained the Puritan idea of exceptionalism, while having forgotten some of the moral constraints upon personal and national conduct that accompanied that idea. For the Puritans, material and military prosperity followed from…

  • Erastian and High Church Approaches to the Law

Open Access•M Cathleen Kaveny•ARTICLE•Journal of Law and Religion•2007

It is a great honor for me to have been asked to contribute to this issue of the Journal of Law and Religion focusing on the work of my colleague and friend, Robert E. Rodes, Jr. In June 2006, Professor Rodes celebrated his fiftieth anniversary as a member of the faculty of Notre Dame Law School. His long career has marked him as a founding father of interdisciplinary scholarship at the intersection of faith, law, and morality—the very sort of sc…

  • Diversity and Deliberation

    Open Access•M Cathleen Kaveny•ARTICLE•Journal of Religious Ethics•2006

This article considers the sort of diversity in perspective appropriate for a presidential commission on bioethics, and by implication, high-level governmental commissions on ethics more generally. It takes as its point of comparison the respective reports on human cloning produced by the National Bioethics Advisory Commission, appointed by President Bill Clinton, and George W. Bush's President's Council on Bioethics, under the leadership of its …

  • Between Example and Doctrine Contract Law and Common Morality

    Open Access•M Cathleen Kaveny•ARTICLE•Journal of Religious Ethics•2005

In Democracy and Tradition , Jeffrey Stout contends that American constitutional democracy constitutes a well‐functioning moral and political tradition that is not hostile to religion, although it does not depend on any specifically religious claims. I argue that Stout's contention is supported by a consideration of the great common law subject of contracts, as taught to first‐year law students across the United States. First, I demonstrate how c…

  • Assisted Suicide, the Supreme Court, and the Constitutive Function of the Law

    M Cathleen Kaveny•ARTICLE•The Hastings Center Report•1997

It not difficult to compose a brief summary of the Supreme Court's assisted suicide decisions that would suitable for bar review study guides and law student outlines: With no dissenters, the Court overturned the decisions of the Second and Ninth Circuit Courts that conferred Fourteenth Amendment protection upon the choice of competent, terminally ill adults to end their own lives with medication prescribed by their physicians. (1) Holding that t…

  • Listening for the Future in the Voices of the Past

    M Cathleen Kaveny•ARTICLE•Journal of Law and Religion•1994

With the publication of After Virtue in 1981, Alasdair Maclntyre revolutionized the study of post-Enlightenment moral philosophy by insisting that it repent of its current pretensions to a view from eternity and confess its temporal roots in the long and motley history of human reflection about the good life.'Almost a quarter of a century earlier, John T. Noonan, Jr., a young Harvardtrained legal scholar who possessed a doctorate in philosophy fr…
