Starting with the apparatus of DNA testing that produces and reifies ethnoracial differences and identities, this article articulates two layers of analysis. This paper analyzes the effects of a perceived transition from a rule-based computer programming paradigm to an example-based paradigm associated with machine learning. In this article, I show why it is necessary to abolish the use of predictive algorithms in the US criminal justice system at sentencing.
