Extractivism as a constitutional bind
This article explores the constitutional implications of an extractivist political economy through material lenses, challenging dominant constitutional theories that marginalise the relationship between legal orders and natural resources. Traditional constitutional thought prioritises political freedom while neglecting the foundational role of necessity – particularly the organisation of human labour in relation to nature. The study traces how ex…
The Cambridge Handbook on the Material Constitution
Despite a long and venerable tradition, the material constitution almost disappeared from constitutional scholarship after the Second World War. Its marginalisation saw the rise of a normative and legalistic style in constitutional law that neglected the role of social reality and political economy. This collection not only retrieves the history and development of the concept of the material constitution, but it tests its theoretical and practica…

Beyond Victimization
The article thematizes the relevance of Paul Kahn’s conception of political sacrifice for contemporary constitutional studies. Kahn’s approach to political sacrifice is compared with another extremely influential theory of sacrifice, René Girard’s theory of sacrifice. The main aim is to show why Kahn’s view of sacrifice in constitutional orders escapes the logic of victimization that affects Girard’s seminal work, and it provides a better underst…
The Legacy of Pluralism
The Legacy of Pluralism
Book Abstract: How should the state face the challenge of radical pluralism? How could constitutional orders be changed when they prove unable to regulate society? Santi Romano, Carl Schmitt, and Costantino Mortati, the leading figures of Continental legal institutionalism, provided three responses that deserve our full attention today. Mariano Croce and Marco Goldoni introduce and analyze these three towering figures for a modern audience. Roman…
The Relationship Between Widespread Pollution Exposure and Oxidized Products of Nucleic Acids in Seminal Plasma and Urine in Males Attending a Fertility Center
This study highlights how oxidative stress on the male reproductive tract can be associated with a different representation of metabolic pathways making the reproductive tract itself a target organ for different environmental pollutants. Our results demonstrate that SP is a suitable matrix to assess the exposure and evaluate the effects of reproductive toxicants in environmental/occupational medicine. The statistical approach proposed in this wor…

Introduction
La Constitución material
What is the material context of constitutional order? The purpose of this paper is to offer an answer to that question by sketching a theory of the material constitution. Distinguishing it from related approaches, in particular sociological constitutionalism, Marxist constitutionalism, and political jurisprudence, the paper outlines the basic elements of the material constitution, specifying its four ordering factors. These are political unity; a…
The Charisma of the European Central Bank
The article expands Paul Kahn’s cultural analysis of the US Supreme Court’s charisma to EU institutions and, in particular, to the European Central Bank. The aim is twofold: on the one hand, the intention is to show the rich potential of the cultural study of law for understanding different constitutional experiences; on the other hand, the aim is to show that political sacrifice may not be the only material for building constitutional imaginatio…
Introduction to the material study of global constitutional law
The article addresses the question of how to study global constitutional law by suggesting a material methodology. Drawing from previous studies of the notion of the material constitution, both from materialist and institutionalist types (Marx, Mortati, Poulantzas), the article proposes to look at the development of global constitutional law, in its many instantiations, in terms of its relation with the state. Accounts of the autonomy of global c…

The Material Constitution
What is the material context of constitutional order? The purpose of this paper is to offer an answer to that question by sketching a theory of the material constitution. Moving beyond the interwar constitutional theories of Heller and Mortati, the paper outlines the four ordering forces of the material constitution: political unity; a set of institutions; social relations, and fundamental political objectives. These forces constitute the substan…

A sense of self-suspicion
Legal pluralism has become common currency in many contemporary debates on law and globalization. Its main claim is that a form of global legal pluralism represents both the most accurate description of law in times of globalization and the best normative option. On the descriptive level, global legal pluralism is considered more reliable than state-based accounts. On the normative level, global legal pluralism is understood as a possibility to o…

Puberty in modernizing Kazakhstan
A relationship between pubertal status and the living environment was present in a rapidly modernizing country such as Kazakhstan
Prevalence of overweight and cardiovascular risk factors in rural and urban children from Central Asia
Kazakhstan is undergoing a rapid modernization process, which carries the risk of an epidemic of obesity and cardiovascular disease. We enrolled a sample of about 50 children for every combination of gender, environment (urban vs. rural), ethnic group (Kazakh vs. Russian), and age group from 7 to 18 years, for a total of 4,808 children. Anthropometry and blood pressure were measured on all children while fasting blood cholesterol and glucose were…
Spirometric reference values for children and adolescents from Kazakhstan
Anthropometry was the most important predictor of spirometry. Age and ethnicity were also predictors, while the contribution of the living environment was more limited
