While the policing of domestic and family violence has gained attention, little focus has been placed on family violence within the context of covert policing. Given the link between family violence and other serious crimes at the centre of covert investigations, it is crucial to examine the ethical and practical dilemmas that arise when family violence is inadvertently detected during undercover operations. Drawing on legislative and policy frameworks, recent inquiries, criminal and civil cases in Australia and the United Kingdom, this article explores the unique cultural context of covert policing and raises potential challenges in responding to family violence. The article focuses on police discretion, role conflict, and duty of care, to emphasise the importance of clear policies and training for covert officers to navigate these complex situations effectively. It calls for greater transparency and guidance to ensure that family violence is taken seriously and addressed appropriately during covert operations
