This article defines “discrimination in employment,” identifies the major legal provisions governing it under United States law, and describes the requirements of Title VII, the most important provision and the one on which most specific legal prohibitions are modeled. In particular, it describes the shifting of evidentiary burdens that typically applies, the limited exception for bona fide occupational qualifications, and sexual harassment. It concludes by describing the requirements placed on employers to accommodate employees' religious beliefs, practices, and physical and psychological disabilities.
