This essay explores the fictionality of the second actio of Cicero's prosecution of Verres in the light of Verres' history of tampering with documents. It argues that both Verres' altered tabulae and Cicero's fictional speech summon communal memory by displaying an absence—with the crucial difference that Verres' alterations to the public record are culpable, while Cicero's are not.
