Law and the Socialist Enterprise

This article examines the problems of law and the socialist enterprise in the system of capital and industrial relations in the United Kingdom. I intend to explore the proposition that the nature of enterprise law (its sources, objectives, functions, and contents) is dependent, inter alia, upon the perspective of different actors - trade unions, employers, judges, political parties, civil servants, legal practitioners, academics, and the media. The socialist view of enterprise law cannot be identified with any of these perspectives, since the actors - even unions - are inevitably bound up with the capitalist system.1 However, by developing this concept of multiple perspectives on law, the paper seeks to elaborate a specifically socialist view of the nature of the law of the enterprise by looking to its sources, contents, functions, and objectives
