Biographically inspired texts always raise the question of the relationship between social reality and fiction. The practice and plausibility of making a literary work of art the subject of juridical debates and verdicts, and in the most extreme cases banning literary works, is discussed by example of Maxim Biller's Esra and Klaus Mann's Mephisto . Here, the potential conflict between general personal rights and the posit of artistic freedom is analysed within the context of censorship and literary-theoretical concepts of literariness and fictionality, in order to take into consideration not only the protection of personal rights, but also the ontological status of art
