The "Marburger Programm" (published in the "Zeitschrift ffir die gesamte Strafrechtswissenschaft," Vol.III, and in Liszt's "Strafrechtlicke Aufsidtze und Vorfrdge" Vol.I (Berlin, 1905), deals with the "Zweckgedanke im Strafrecht" i. e., the idea that the infliction of punishment is only a means to an end and not an end itself.$This means: poena ne peccefur, as contrasted with the "VergeltungsStrafe" (punishment for the sake of retaliation = poena quia peccatum est)
