The human rights of intersex people: addressing harmful practices and rhetoric of change

Resumo
Intersex people have been subjected to harmful practices justified by the rhetoric of protecting children and upholding social norms. These practices include medically unnecessary interventions on infants and children, and discriminatory treatment across the life course. This paper examines the human rights implications of these practices, and the rhetoric used to justify them. It argues that intersex people have the same fundamental human rights as everyone else, including the right to bodily integrity, to be free from torture and ill-treatment, and to non-discrimination. It also examines the growing international momentum to address these human rights violations, including through the work of United Nations human rights mechanisms and treaty bodies, and the increasing number of States that have condemned harmful practices on intersex people. The paper concludes with a call for further action to protect the human rights of intersex people, including through legislative and policy reforms, public education campaigns, and the provision of support services.
