There are seas of ink and heated debates surrounding this assisted human reproduction technique, which represents a conceptual shift in the definition of motherhood. Surrogacy raises global controversies, and its growing acceptance challenges traditional conceptions of motherhood, filiation, and family. Questions about the role of women and gestating bodies provoke conservative reactions as well as criticism from feminist perspectives. Through a qualitative examination of conventions, jurisprudence, and communication materials from European and Inter-American organizations, we will critically analyze the discrepancies between different legal systems of the international community regarding the challenges of reaching a consensus that protects minimum standards of rights and ensures their continuity in cross-border situations through the inescapable gender and human rights perspective required by this concept
