이 논문은 법치주의가 억압전략의 헤게모니 장치로 도구화되는 맥락을 비판적으로 검토하는 데 목적이 있다. 이를 위해 우선 정치적 억압의 체계와 전략에 관한 이론적 논의에 기초해 법치주의와 억압전략의 부정한 결합이 이루어지는 권력장의 조건과 맥락을 검토한다. 이어서 공안사건에 초점을 맞춰 억압전략으로 도구화된 법치주의가 전면화되는 역사적 맥락성을 비판적으로 살핀다. 마지막으로 결론에서는 권력장의 헤게모니 장치로서 법치주의의 양면성을 강조하면서 논의를 마무리한다. 불안정하고 불평등한 권력관계로 인해 위축된 민주주의에서는 법치주의가 정치적 미사여구이자 억압의 기술로 도구화될 수 있다는 사실에 주목할 필요가 있다
