This article explores racial disparity in the Brazilian criminal justice system as a manifestation of entrenched structures of power, ideology, and social control. Drawing on Althusser’s theories on ideology and the ideological state apparatuses, as well as Pachukanis’s critiques of criminal law in the bourgeois state, the discussion examines how law not only reflects but also perpetuates racial inequalities. The research employed deductive methods within a qualitative approach and exploratory investigation based on direct bibliographic sources, relying primarily on the concepts of Pachukanis, Althusser, Aníbal Quijano, Frantz Fanon, Silvio Almeida, and Lélia Gonzalez. The analysis shows that criminal policies, particularly within the war on drugs, intensify phenomena of racial profiling and the marginalization of minority communities. It is understood that effective transformation requires a break with the economic and legal structures that uphold structural racism in the Brazilian criminal justice system
