This research aims to investigate how globalization and human rights interfere in the conception and exercise of state sovereignty (whose transformations delimit the analysis of the paradigmatic crisis underway) and how these interrelations impact the State and the Law. We aim to demonstrate that both factors decisively impact upon the dynamic of the institutions forged in modernity, creating the need for a new paradigm of understanding for these relations based on a broad rethinking of these structures. The investigation adopts the methodology of the phenomenological-hermeneutic approach, based, especially, on Heidegger’s maxim of “the things themselves”, since the proposal, in line with the method adopted, does not so much characterize the real essence of the objects of investigation, but rather their means, that is their ‘how’, in opposition to constructions floating in the air or discovered accidentally
