This text provides a commentary on the thesis “The Paths of Insurgent Law”, developed by Celso Soares between 1983 and 1984. His essay presents itself as a pioneer in formulating the expression “Insurgent Law”, which would be revived by several subsequent generations of critical theorists of law and popular legal advisors, from the Institute Popular Legal Support (AJUP) to the Institute for Research, Rights and Social Movements (IPDMS). The interpretation presented here suggests four “wanderings” by the author in his text, which represent contributions, with potential and contradictions at the same time, namely: Insurgent Law as an enclave; the problem of the guarantee that escapes from insurgent legal reflections; the oscillation between heterodoxy and eclecticism in the Marxist theoretical basis; and the need for mediation that overcomes the opposition between juridicism and legal abstentionism
