This chapter concerns Fichte’s philosophy of right, politics, and justice and Fichte’s later political thought. It deals with the separation of right from ethics in Kant and Fichte; Fichte’s foundation of right: recognition, the relation of right, and the normative concept of right; how Fichte’s derivation of right involves the combination of factual and normative claims, and a normativity entirely independent of morality or ethical duty; Fichte’s conception of the state as grounded on contracts; the forms of legitimate government; the “ephorate” as a protection against governmental abuse of power; Fichte’s conception of individual rights and of penal law; his defense of individual liberty in self-regarding matters; his anti-retributivist justification of punishment and rejection of the death penalty; the family, sexual love, and the social position of women; property and economic justice; and Fichte’s argument that basic justice requires redistribution of wealth from rich to poor and strict state regulation of the economy
