This article examines the social functions of French labor courts (Conseils de Prud'hommes), questioning their role as judges or arbitrators. The authors analyze the historical evolution of these courts, their composition, and their procedures, highlighting the tension between their judicial authority and their aim to promote conciliation and social peace. They argue that the Prud'hommes, while formally part of the judicial system, operate in practice as a hybrid institution, blending legal and extra-legal considerations in their decision-making. The article explores how this duality reflects the broader social and political context of labor relations in France
