This article examines the situation of indigenous peoples in the prison system of Roraima State, in northern Brazil near the Venezuela-Guyana border. Since early colonisation of this region in the late 18th century, indigenous peoples were seen as a threat to the colonising process and incarcerated in settlements for forced labor as slaves. Despite the 1988 Brazilian Federal Constitution which recognizes differentiated indigenous rights, they are systematically disrespected in the prison system. I discuss here how the common idea that "everyone is equal before the Law" is in conflict with ideas about indigeneity and indigenous rights and paradoxally leads to various forms of injustice suffered by indigenous peoples
