In Mexico, a megadiverse and multicultural country, peoples and social groups settled in it have established a unique human-nature relationship for each social group, and in whose territories tangible and intangible elements coexist recognized as biocultural heritage. There is a lack of definition about what biocultural heritage means in the Mexican law, especially to the way in which can be preserved over time and transgenerationally safeguarded and managed by the local groups.A review of the Mexican legislation (laws, regulations, agreements, law initiatives and treaties) related to the concept of Cultural and Biocultural Heritage was carried out, in order to have elements that allow the elaboration of a proposal of determination of Biocultural Heritage and its legal protection based on a diachronicity that ensures its legal recognition or the development of legal mechanisms for its conservation
