This text aims to identify the theories of property rights \nthat are involved in the Constitutional Court and the \nSupreme Court rulings on the issue of the allocation \nof private property rights on vacant lots showing their \ntensions and recent interactions. Then, the theories of \nutilitarianism and Locke’s theories initially explained \nare associated with the arguments reviewed in \n17 judicial decisions of the Constitutional Court \nand the Supreme Court referred to writs of amparo \nbetween July 2014 and October 2016. The review \nshows the arguments of the Constitutional Court \nwith the utilitarian theory that was supported by the \nSupreme Court, except in early 2016 when notions of \nLocke’s theory about property rights were accepted. \nIn addition, attempts to abstract the discussion on \nvacant lots from the constitutional sphere to move it \nto the usual civil law scenario are being made
