The present work has as the main objective to answer the following question: the positivist criminology represented by the work of Nina Rodrigues constructed discourses of social control racialization in relation to women?To answer such a question, we analyze the following publications of the author: "As raças e a responsabilidade penal no Brasil" (1894), "O animismo fetichista dos negros baianos (1896), "Mestiçagem, Degenerescência e Crime" (1899), "As formas do hímen" (1900) and "Os africanos no Brasil" (1933).We based ourselves on the concept that the knowledge of criminology orientates itself on a practical side: ensure a social order, as well as that there is a link between practices and social representations.Such considerations have a purpose of understanding that the female representations present in the discourse of Nina Rodrigues on these publications constitute in mechanisms builders of different relations of women with the instances of social control.We point out that the qualifications that the author uses to refer to women are built based on a racial dimension, and this is the central point, which determines the locus that conditions the role of a victim or a criminal to women
