The present master's thesis discusses the subject of private land ownership in Brazil and has as theme the historical construction of the modern concept of it (private land ownership in Brazil). The general objective of the research is to understand, through the analysis of policies and documentary sources, being aimed at the presence of synchrony and diachrony in the event of the tradition, the way the concept of private land ownership in Brazil had being built from 1530 to 1850.This period was chosen because it encompasses, at one end, the first policies imposed by Metropolis, the pattern of land occupation in Brazil, and extends to the policy framework of its mercantilization, which occurred with the advent of 1850's Land Law.It is intended, through a long retreat, to plot a narrative that encompasses the synchrony and diachrony of the legislative movement that regulated the land occupation in Brazil, keeping in mind that from the invasion to conquest, up to nowadays, Brazilian History is crossed by violent domination relations that are very often institutionalized. The question to be answered is: in a synchronic and diachronic analysis, what are the elements of permanency and rupture that can be recognized in the policy sources (c.1530 to 1850) that regulated the occupation of land in Brazil and conformed the concept of property of the land? The hypothesis of the study brings the idea that the conformation of the tradition about the concept of private property can only be unveiled contemplating diachrony and synchrony, since both elements of permanence, which double explain and justify the retreat to Rome, the Middle Ages and modern European State, such as those of rupture which marketed and inaugurated a new form of access to land, are indispensable in the historical construction of the modern concept of private land ownership in Brazil. The research is based on the long-term method and consists of a qualitative analysis of policy and documentary sources. The results of the research show that the construction of the concept of ownership of private land in Brazil is linked to favoring -from the slicing of the territory of Pindorama with the distribution of hereditary captaincies through the institute of the sesmarias until the advent of the Land Law of 1850 , which inaugurated a new meaning of the concept of vacant land and commodified the land through the institute of buying and selling -of the hegemonic classes, sacralizing a certain type of property, as well as alleviating the impoverished sectors of access to land, becoming one of the basis for social injustice. It is concluded that the study of the historical roots of the institute of private land ownership in Brazil can help in understanding -and consequently combating -social injustices
