Despite the strength and diffusion of the Pachukanian theory according to which the legal form derives from the mercantile form, we intend to demonstrate that the category legal form is not as central to Marx as it seems to be at first sight.Forms like contract, property, justice, juridical transactions are criticized by Marx, certainly.However, we try to prove, from the analysis of The Capital, mainly from book III, that the correlation of these forms with the commodity form, as a rule, is much more mediated and indirect than what Marxist criticism of Law, within Pachukanis as a main influence, seems to suggest
