This dissertation investigates the circularity of the concept of money. This problem was the driving force of the most diverse analyzes on the subject.Within these studies, two main streams are used to overcome this currency circularity. The first tries to qualify money as a special commodity; the second, as a fruit of the political relations of society. In this work, we call the first current object-money and the second power-money.Despite being very different from each other, both fail to overcome the currency circularity problem. To face this problem, the systems theory elaborated by the sociologist Niklas Luhmann is mobilized. With this, it is possible to think about the concept of money not to overcome this circularity, but from the circularity. The biggest hurdle in incorporating this new approach is dealing with the legal sociology of systems theory.Like economics, law also presents a circularity in its construction. However, for Luhmann, law cannot lend its regulation or its elements to the economy. To resolve this contradiction in Luhmann's thesis, we argue that the law abdicated the power to intervene in the monetary authority and to regulate the purchasing power of money. This expands functional differentiation as a major characteristic of our society
