Outsourcing is a phenomenon of liberal aspect in the labor economy, with diverse peculiarities as to the degree of comprehensiveness and impacts in the labor relations.The research on its origins, evolution and effectiveness in Brazil is a matter of recognized relevance, since in a diversified economy, in a country with such potentialities, labor legislation plays a prominent role in the set of national productive factors.Historical, philosophical, social and legal aspects were brought to the scene in order to determine which of them contributed most decisively to the current state of the phenomenon on national lands.Likewise, to deepen the study on the humanistic question, involved in its implementation, was essential to unveil the socio-economic consequences of the implementation of this model of hiring of labor.In this plan, the effectiveness and the entry into force of outsourcing, sought to demonstrate the existence of a collision between fundamental principles of the Constitution of the Republic, and, additionally, the need for compliance and compliance with social rights, consolidated in the subjective sphere of the worker, for any limiting acts of rights.It was concluded that the outsourcing is economically and socially significant, although, in the balance of principles affected by it, the restrictions imposed by its implementation, especially the rights of the dignity of the human person, impresses the mark of unconstitutionality
