This thesis aims to discuss the role fulfilled by the concept of "subject of law" in Marx's "critique of political economy", exposed in Capital.For this purpose a definition of this "critique" is not taken as an economic theory, but as a general problematic that conceives capitalism as an integral social reality, experienced by individuals as a universal-natural experience, in which they are completely immersed and that shapes each sphere of the experience, activity, language, desire.Such a definition finds strength in a reading of the first section of Book I of Capital which emphasizes the role of the concept of "value form" and the theory of commodity fetishism as constituents of a social sphere of imaginary action and representation, which is simultaneously objective and subjective.Next, an analysis is made of the functions of the concept of "subject of law" in the composition of this problematic.With special attention to the way in which this category emerges logically/ historically in/according to the text, we point to the virtual existence in Capital of a "dual character of juridical subjectivity", correlated, as the term suggests, to dual character of commodity and the double character of labour.This allows us to expose the role of the category of "subject of law" in the articulation between the objective dimension and the subjective dimension of social reproduction, evidencing from its dual form of appearance -as abstract subject and as concrete subject -its constitutive position in the elaboration both of a theory of action as well as a theory of representation
