This article provides an account of a historical, social, political and legal analysis on the existence of a set of elements that enable the emergence, scope and application of the principle of conventionality as a legal and constitutional tool with international roots that, in the Colombian case, arises from a new political reality (Social Rule of Law). It is also an application mechanism, resulting from the national Constitution, the approval and ratification of international treaties on human rights, the imperative importance of principles as basic rules and jurisdictional participation. All of the above is for the protection of the human right to political asylum in Colombia, as well as other rights of equal category. This result is achieved from qualitative research, under a deductive and inductive method, based on a methodology and content analysis that is carried out through an explanatory, comparative description and empirical and analytical observation
