Social rights have been recognized in international law as well as through various domestic laws. However, in comparison to civil and political rights, they are still considered as •half-rights”. Such a differentiated treatment tends to be criticized, by both social movements and doctrinal works, partially followed by international and national jurisprudence. This paper written by Professor Hiroshi Sasanuma, translated into French, offers one among the very few doctrinal works dealing in Japan with the protection of social rights and give a contrasted analysis of the question. If some Japanese legal scholars strongly advocate the indivisibility of human rights, the judiciary still remains hesitant to this regard and judicial decisions are slow to strengthen the •justiciability”, the effectiveness and the opposability of social rights
