The duty of care tries to resolve a public health problem through penal means. In relation to the war against drugs, the law of 31 December 1970 created different obligations to care in relation to drug users. The confrontation to be seen in meetings between those from the two institutions involved, the Ministry of Health and the Ministry of Justice, shows the difficulty of putting into practice this kind of policy and shows why it continues to be a theoretical duty. The objectives of these duties of care have been changed numerous times since 1970, as have been the populations concerned, but always using administrative means, rather than having recourse to the legislature. The contamination of the drug addicted population by the AIDS virus and by hepatites and the identification of intravenous drug users as a risk group capable of spreading the epidemic into the general population has reactivated the question of the duty of care in a new context of risk reduction. However, in this return to a public health approach, it is noticeable that magistrates are recoiling more and more from using legal measures despite the provisions of the 1970 law
