Two prominent categories designate crime and insecurity in the French public debate: violence and incivilities. The article is an attempt to investigate their history, their consequences on public policies, but also their heuristic inadequacy. Thus, the second part of the paper presents a statistical monograph, allowing to examine the ordinary nature of illegalisms, taken as situations constructed as such by their participants. The predominance of two kinds of illegalisms emerge : those against property (theft, vandalism) and community disturbances (arguments, insulting, brawls). These types of situations relate to statistically observable social rationales
