One of the most vexatious issues for pragmatic political and legal analysis is the tension between holding to ideals as aspirations and to pragmatic commitments where all political and legal claims are assessed in terms of contingent social fact and consequentialist considerations. An exemplary law review article from a pragmatic perspective about political aspirations for democratization in the United States, by Michael C. Dorf and Charles F. Sabel, provides the context and the material to explore this vexatious issue, in both theoretical and substantive legal and political terms. A detailed analysis of selected elements, especially in regard to what they refer to as benchmarks and best practices, is the means of my challenge to pragmatists to make their ideals explicit and encourage critical self-scrutiny. By way of conclusion, I propose an "agnostic skepticism" about ideals as aspirations with social fact and consequentialist considerations as a way of meeting this obligation
