In light of current discussions concerning theories of equality and social justice, this article argues against an employment policy prescribing identity of treatment to secure equality of opportunity for the sexes. Mary Segers examines the theoretical and practical deficiencies of such an approach and finds that contemporary employment policies, which profess to be neutral, penalize one sex by applying a pattern designed for the other. She advocates the need for differential consideration to rectify the injustice of such policies
