Des études récentes démontrent que les changements idéologiques, les boule-versements sociaux et la capacité des élites locales de manipuler le processus législatif au détriment des autres classes ou groupes sociaux avaient dans le passé, comme elles l'ont encore aujourd'hui, une profonde influence sur l'évolution des lois criminelles. C'est ainsi que le code pénal est régulièrement remodelé et que certains comportements sociaux sont périodiquement criminalisés ou décriminalisés selon l'idéologie, les problèmes sociaux et les forces sociales en présence. Les lois criminelles reflètent donc les craintes et les valeurs d'une société donnée à un moment précis de son histoire et représentent ainsi une source essentielle pour analyser l'arrivée de nouveaux modes de contrôle social. Mais plus encore, l'étude de l'évolution des lois criminelles permet à l'historien de voir comment de nouvelles définitions de la criminalité sont liées à de nouveaux rapports sociaux.1
