Heritage Protection on Indian Reserve Lands in Canada

The summer of I990 was an eventful season for Indians in Canada. Indian activism had forced the country to recognize their claims and to address outstanding issues. At Peigan, the Lonefighters Society had embarked on a campaign of protest over the impounding ofwater on the Oldman River upstream from the reserve. Once constructed the dam would create a reservoir and flood many archaeological sites considered sacred traditional sites by the Peigan. At the same time I was conducting afield survey of archaeological sites on the Peigan Reserve and I began to wonder about the sites I discovered and if it was possible to protect them under prevailing statutes, most notably the Indian Act. It soon became apparent that in this regard the law is silent. Indian lands are a federal responsibility; thus, the absence of federal legislation for heritage protection leaves a gaping legal vacuum. Introducing new legislation is cumbersome and time consuming, but the loss of heritage sites is immediate. Therefore I limited my search to existing statutory vehicles that may provide remedial procedures to extend protection to heritage sites on Indian reserves
