An early version of this article was presented at the Justus-Liebig-Universitat-Giessen, Germany in June 1993 and to the Law Faculty of the University of Wisconsin, Madison in October 1993. Parts of the paper were also presented to the Law Faculties of the Tulane Law School and SMU School of Law during 1994-95 when I was a Visiting Assistant Professor of Law at both schools. Various people have been subjected to dialogue on aspects of the paper, including students in comparative federalism seminars at SMU in 1994 and 1995 and at the Tulane Law School in 1995. Thanks are given to all these people and in particular, to Professor Ken Penegar of SMU School of Law, Professor Shael Herman of Tulane Law School and Professor Graeme Dinwoodie of the University of Cincinnati College of Law, who have been especially subjected to my thoughts on federalism in the U.S. and EU.
