In two recent decisions the Court of Justice of the Communities (or European Court) was asked to resolve some fundamental questions on the construction and application of the principles of Community law applicable to the equal pay of men and women. In the first, Case 69/80, Worringham and Humphreys v. Lloyds Bank,l the Court was concerned with the application of those principles to an occupational pensions scheme established by a bank for its staff. In the second, Case 96/80, Jenkins v. Kingsgate (Clothing Productions) Ltd. ,2 it confronted the problem of determining whether discrimination between full-time and part-time workers was tantamount to discrimination between men and women.
