  • Organizational Conflict Resolution and Strategic Choice

    Open Access•David B Lipsky, Amos Avgar et al.•ARTICLE•Industrial and Labor Relations…•2020•Citada por: 2•Referencias: 13

This article examines the strategic underpinnings of firms' use of alternative dispute resolution (ADR) practices. The authors argue that a firm's strategic orientation and commitment to ADR shape its adoption of dispute resolution techniques-such as mediation and arbitration. Firms vary in the benefits they seek to gain from adopting ADR practices, and firm-level use is affected by these anticipated benefits. The authors also propose a link betw…

  • Resolving Discrimination Complaints in Employment Arbitration

    Open Access•J Ryan Lamare, David B Lipsky•ARTICLE•Industrial and Labor Relations…•2019•Citada por: 2•Referencias: 14

This article empirically examines whether employment discrimination claims differ from other types of disputes resolved through arbitration. Whether arbitration is appropriate for resolving violations of anti-discrimination statutes at work is a focus of ongoing policy debates. Yet empirical scholarship has rarely considered whether different types of complaints might have distinct characteristics and receive varied outcomes in arbitration. The a…

Ariel C Avgar, David B Lipsky et al.•BOOK•Managing and Resolving Workplace…•2016

In recent years many employers in the U.S., Great Britain, Ireland, and elsewhere, often in partnership with their unions, have turned to new approaches to managing and resolving workplace disputes. In the U.S. this movement is often called "alternative dispute resolution" (ADR), an approach that involves the use of mediation, arbitration, and other third-party dispute resolution techniques, rather than litigation, to resolve workplace disputes. …

  • The Long Haul Effects of Interest Arbitration

    Open Access•Thomas A Kochan, Thomas Kochan et al.•ARTICLE•Industrial and Labor Relations…•2010•Citada por: 2•Referencias: 20

The authors examine debates about the effects of mandatory interest arbitration on police and firefighters in New York State under the Taylor Law from 1974 to 2007. Comparing experience with interest arbitration in the first three years after the law was adopted with experiences from 1995 to 2007, the authors find that no strikes occurred under arbitration and that rates of dependence on arbitration declined considerably. Moreover, the effectiven…

  • The Composition of Strike Activity in the Construction Industry

    David B Lipsky, Henry S Farber•ARTICLE•Industrial and Labor Relations…•1976•Citada por: 3

This study shows that strikes in construction have, by most measures, increased during the years since 1949, a period during which strike activity tended to decline in American industry as a whole. The authors demonstrate that this increase has resulted not from an increase in the number of wage disputes but from a growing number of jurisdictional strikes and the increasing severity of economic and union-organizing strikes. They also show that th…

  • Interplant Transfer and Terminated Workers

    David B Lipsky•ARTICLE•Industrial and Labor Relations…•1971

[Excerpt] The design of policies intended to aid workers who are threatened with displacement involves issues of a complex and difficult nature. The need for careful analysis of the issues is emphasized by Thomas Kochan's comment on my recent article. In that article I tried to point out the limitations of my analysis, the difficulties of generalizing on the basis of a case study, and the tentative nature of my conclusions. Space did not allow a …

To those electing not to transfer, the Corporation offered severance pay. Less than a fourth of employees transferred to the new location. This study analyzes in detail the characteristics of the movers and nonmovers and the …

  • The Effectiveness of Reinstatement as a Public Policy Remedy

    Open Access•John E Drotning, David B Lipsky•ARTICLE•Industrial and Labor Relations…•1969•Citada por: 2

This article is concerned with two aspects of the NLRB reinstatement remedy as applied in the famous Kohler case: (1) how effective the remedy was, particularly in terms of the number of employees who returned to Kohler under its protection, and (2) what factors, in order of significance, affected a worker's decision to return. The authors find the remedy was effective, since about 40 percent of those workers who received reinstatement offers acc…
